Mr A – Complaint Against Blackhorse

Mr A bought an approved used BMW on finance with Blackhorse for around £15,000. Mr A had the car serviced as required but 2 years after taking delivery of the vehicle the timing chain prematurely failed, causing catastrophic engine failure and requiring its replacement at a cost of around £8,000.

The vehicle type had a known issue with premature timing chain failure, which the dealer failed to disclose, contrary to The Consumer Protection from Unfair Trading Regulations 2008.

The matters referred to above were referred to Blackhorse who concluded that the time Mr A had owned the car proved it was of satisfactory condition at the point of sale.

Nevertheless, BMW offered a goodwill contribution towards the cost and Mr A instructed us to pursue Blackhorse for the remainder.

The case was prepared and referred to the Financial Ombudsman who found in Mr A’s favour, ordering the finance company to pay him the balance of the vehicle repair costs.
