Supply and repair to a luxury car
We were asked to provide advice in conference and a written second legal opinion to a claimant in a £120,000 claim involving a luxury vehicle. Although the litigation was significantly advanced, the Claimant had become increasingly concerned his solicitors were lacking in motor trade and vehicle specific knowledge.
This was apparent from the particulars of claim, a failure to provide a ‘Reply’ to the defence and was amplified by the instructed solicitor’s inability to properly interpret expert evidence and ask pertinent Part 35 questions.
There is no doubting obtaining an expert second legal opinion early enables the you to adjust the strategy accordingly and make the necessary court applications, such as amending the statement of case, specific disclosure or admission of supplementary witness statement.

Sale of a defective luxury car
We were instructed to advise a claimant in a claim involving a luxury car bought from a dealer with extensive poorly repaired historical collision damage. The Claimant had been represented by a solicitor who claimed to be suitably experienced in car rejection claims.
The Claimant became suspicious of the advice he had been receiving from the current solicitor, the amount being charged by them and growing criticism from friends and family that the solicitor was unable to assimilate motor vehicle engineering information and evidence.
We supplied advice in conference and a written legal opinion in the form of a witness statement, correcting and expanding upon the central issues both of fact and law. We also supplied advice on and drafted instructions to the single joint expert, which supported the client’s case.
Jaguar and Range Rover DPF problems
