Legal Costs Deter Businesses from Court Action

A recent survey has revealed that most businesses, companies and private individuals don’t pursue even strong legal claims simply because of the cost of litigation and the increase in the cost of arbitration.

Aside from small claims, where the costs are fixed, higher value claims over £10,000 and over £25,000 easily rack up costs equal to, if not in excess of, the claim value and it’s not difficult to see why.

Traditionally a claimant will refer the matter to a solicitor, paying them a retainer and engaging them on the usual hourly tariff of between £183 and £350/hour depending on seniority. A handful of letters, a few phone calls later and it’s easy to see your way to paying £8-£10,000.

Then, of course, there will be barristers’ fees to provide a legal opinion, draft the particulars of claim and the witness statements, which could add another £3-5,000 to the bill.
